TERMS & CONDITIONS OF YOUR HEALTHY CHOICE
ONLINE SHOP

I. Definitions

The terms used herein shall be:

1 Client - an existing person or company (orders in the Shop can't be made using an alias or pseudonym)
2 Civil Code - Act of 23 April 1964 (Journal of Laws No. 16, item. 93, as amended.)
3 Regulations - the Terms of Service, viewable via the Online Store of Your Healthy Choice;
4 Online Shop (Shop) - Internet service is available at www.yhc.ie through which the customer may place his/her orders;
5 Goods - the products presented in the Online Shop;
6 The sales contract - a contract of sale of the Goods within the meaning of the Civil Code, concluded between the Your Healthy Choice and Client, which is entered using Store web site;
7 Act on special conditions of consumer - the Act of 27 July 2002 on the specific conditions of consumer sale and amending the Civil Code (Journal of Laws No. 141, item. 1176, as amended.)
8 The Act on Electronic Services - Law of 18 July 2002 on the provision of electronic services (Journal of Laws No. 144, item. 1204, as amended.)
9 Order - the Customer, aiming directly for the conclusion of the sale, specifying in particular the type and quantity of the Goods.

 

II. General Provisions

2.1. The Regulations are the rules for the use of the online store available at www.yhc.ie.
2.2. These Regulations are the rules referred to in Art. 8 of the Act on Electronic Services.
2.3. Shop, under www.yhc.ie, run by Jaroslaw Mrowinski.
2.4. These Terms and Conditions are:
a) the rules for the registration and use of the account in the shop;
b) the terms and conditions for placing an order in the online store;
c) the terms and conditions for the procurement of goods in the shop;
d) the rules of contract sales using the services provided by the online store.

2.5. Using the online shop is possible provided that the computerized system, which the customer uses, thr following technical requirements:
a) Internet Explorer version [...] or higher-enabled [list of necessary applications, such as Java applets], or
b) [Internet Browser] version [...] or higher-enabled [...] c) a minimum screen resolution of [...] x [...] pixels.
2.6. In order to use the online store, the customer should get their own access to a computer or terminal device with Internet access.
2.7. In accordance with applicable laws, YHC reserves the right to limit the provision of services via our Online Store for those over the age of 18 years. In this case, potential customers will be notified of the above.
2.8. Customers can get access to these Rules at any time through the link found on the main site www.yhc.ie and download it.
2.9. Information about the Goods quoted on the website Shop, in particular their descriptions, technical and performance characteristics and price, are an invitation to purchase items, within the meaning of Art. 71 of the Civil Code.

 
III. Terms of use of the Online Shop

3.1. In order to use the online store,you must be registered to the YHC website.
3.2. Registration takes place through the completion and acceptance of the registration form, which is available on one of the website pages.
3.3. By registering, you agree to the Terms of Use and provide personal information marked as mandatory.
3.4. Your Healthy Choice may withdraw the right to use the online store as well as limit your access to parts or all resources of the online store, with immediate effect, in the event of a breach  of the rules by the client and, in particular, the Customer must:
a) indicate when registering online store data that is incorrect, inaccurate or outdated, misleading or that could violate the rights of third parties,
b) Refrain from interfering with the personal store account of any other customer.
c) allow the other behaviors that are considered by Your Healthy Choice for behavior inconsistent with applicable law or the general principles of the use of the Internet or detrimental to the good name Your Healthy Choice.

3.5. A person who has been deprived of the right to use the online store can not register again without prior consent of Your Healthy Choice.

3.6. To ensure the security of transmission of messages and data in connection with the services provided in the Website services, shop take technical and organizational measures appropriate to the seriousness of the security services, in particular measures to prevent acquisition and modification by unauthorized personal data transmitted over the Internet.

3.7. The Client shall in particular:

a) not produce content and may not prohibited by law, such as violent content, defamatory or infringing personal rights or other rights of third parties,
b) the use of the Online Store without disturbing its functioning, in particular through the use of specific software or devices,
c) to refrain from actions such as sending or posting in the Online Shop unsolicited commercial communications (spam)
d) use of the Online Store without major inconvenience to other customers, and for Your Healthy Choice
e) use of any content contained in the Online Shop only for personal use,
f) use of the Online Store in accordance with the provisions in force in the Republic of Ireland, the provisions of the Regulations, as well as the general principles of the use of the Internet.

 

IV. The procedure for the conclusion of the sale

4.1. For the conclusion of the sale through the online store, go to the website www.yhc.ie, make your choice, taking technical steps based on the Client displays messages and information available on the site.

4.2. Selection of Goods ordered by you is made by adding them to your cart.

4.3. When submitting orders - until you press the "Place Order" - The customer has the option to modify the input data and the selection of the Goods. To do this, follow the onscreen prompts to the Customer and the information available on the site.

4.4. After administration of the Customer uses the Online Shop with all the necessary data, you will see a summary of your order. Summary complex contracts will contain the following information:
a) the object of the contract,
b) unit and the total price of the products or services, including shipping costs and additional costs (if any),
c) the chosen method of payment,
d) selected method of delivery,
e) the time of delivery,

4.5. In order to send orders it is necessary to accept the Terms and Conditions, personal information marked as mandatory, and pressing the "Place Order".

4.6. Sending the Customer Order is a declaration of intention to conclude the Your Healthy Choice Purchase Agreement, in accordance with the Regulations.

4.7. After placing an order, the customer receives an e-mail entitled "Confirmation of the order - Your Healthy Choice" containing final confirmation of all the essential elements of the Order.

4.8. Agreement shall be deemed concluded at the moment of receipt of the e-mails referred to above.

4.9. The sales agreement is in English, its content in accordance with the Rules.

 

V. Delivery

5.1. Delivery of Goods shall be limited to the area of ??the Republic of Ireland and is the address specified by the customer when placing orders.

5.2. Delivery of ordered goods carried in the transport company, or courier. Your Healthy Choice reserves the right to change the customer chooses the method of delivery. Shipping costs choosen by the buyer, it will be charged at the time of the order, is:

5.3. Time of delivery is from time order received to 6 working days from the date of dispatch of the Customer Order.

5.4. Customers can get access to these Rules at any time through the link found on the main site www.yhc.ie and download it and draw its output.

Consolidation, security, access and the customer confirmation of the relevant provisions of the Agreement, the sale of Goods by sending to you at your e-mail, and by adding to the package containing product Print confirm the specifications of the Contract and invoice.

 
VI. Pricing and payment methods

6.1. Commodity prices are given in Euros and include all components, including VAT (with distinction from the rate), customs and any other components

6.2. The customer can pay by:
a) transfer to the bank account specified in the information about the store,
b) payment system PAY PAL
c) Payment on receipt of goods ( only in Dublin area).

VII. The right to withdraw from the contract

7.1. Client, who is a consumer within the meaning of Art. 221 of the Civil Code, entitled - under the law - the right to withdraw from a distance contract, without giving any reason, making a statement in writing, minimum of 14 working days counted from the date of delivery of the goods, and sending them to Your Healthy Choice, 54 Castaheany, Clonee, Dublin 15, Republic of Ireland.

7.2. 14-day term is counted from the date of delivery of the Goods.

7.3. If you withdraw from a distance contract, the contract is considered null and void. This is what the rendered shall be returned unchanged unless a change was necessary in the ordinary course of business. Recovery shall be effected without delay and no later than within 14 days. The purchased goods must be returned to the following address: Your Healthy Choice, 54 Castaheany, Clonee, Dublin 15, Ireland.

7.4. Goods returned by the customer should be shipped in an appropriate manner to minimise further damages.
7.5. The direct cost of returning the goods may be imposed on the consumer.

 

VIII. Complaints relating to the Goods

8.1. Your Healthy Choice as the seller is liable to the Customer who is a consumer within the meaning of Art. 221 of the Civil Code, for non-compliance with the Agreement, the sale of the Goods purchased by the consumer, to the extent specified in the Act on the specific terms of consumer sales.

8.2. Claims arising from the breach of customer rights guaranteed by law, or under these Rules, should be addressed to yhcservice@gmail.com. Your Healthy Choice is obliged to consider a minimum of 14 days, and if it is not possible to inform the customer in that period when the complaint will be dealt with.

8.3.Your Healthy Choice is not the producer of the goods. The producer is liable under the guarantee of the Goods sold under the conditions and for the period specified on the label. If buyer is unhappy with the produc, may submit their claim immediately on yhcservice@gmail.com

 

IX. Complaints in the provision of electronic services

9.1. Your Healthy Choice is taking steps to ensure the proper functioning fully Store, in so far as it results from the current technical knowledge and is committed to remove within a reasonable time any irregularities reported by customers.

9.2. The customer is obliged to immediately notify the Your Healthy Choice of any irregularities or interruptions in the functioning website online store.

9.3. Irregularities relating to the functioning of the Store Customer can request in writing to the address yhcservice@gmail.com e-mail or by using our contact form.

9.4. In the complaint, customer must provide their name, mailing address, gender and date of irregularities related to the functioning of the Store.

9.5. Your Healthy Choice is obliged to consider each claim within 14 days, and if it was not possible to inform the customer in that period when the complaint will be dealt with.

 

X. Final

10.1. Settlement of any dispute arising between the Your Healthy Choice and the customer who is a consumer within the meaning of Art. 221 of the Civil Code, shall be subject to the courts of in accordance with the relevant provisions of the Code of Civil Procedure.

10.2. Settlement of any dispute arising between the Your Healthy Choice and the Customer is not a consumer within the meaning of Art. 221 of the Civil Code of the Civil Code, shall be subject to the court with jurisdiction over the seat of Your Healthy Choice.

10.3. In matters not covered by these Rules shall be governed by the Civil Code, the Act on Electronic Services and other relevant provisions of Irish law.
